The Reserved Group on Business Law of the TJ-SP (Court of Justice of São Paulo) reviews its pronouncements.
The Reserved Group of Business Law of the Court of Justice of São Paulo, due to the modifications brought about by Laws 14.112/2020 (Judicial Reorganization and Bankruptcy) and 13.966/2019 (Franchising), approved the revision of the statements previously issued by the collegiate body.
The statements were revised in a session held on April 27, 2021. Among the changes are the cancellation of statements II, which dealt with the judicial supervision period of recovery processes; VII, which allowed prior verification in case of suspected fraudulent use of judicial recovery; and XIV, on deadlines stipulated in Law 11.101/2005.
In all three cases, the judges justified the cancellation due to legislative changes brought about by Law 14.112/2020, which addressed the topics of the statements. Therefore, there was no longer any reason to maintain the texts.
The statements summarize the understanding of the area and represent an important action in the standardization of judgments. The Group of Reserved Chambers of Business Law is part of the Private Law Section, presided over by Judge Dimas Rubens Fonseca.
The 1st Reserved Chamber of Business Law is composed of judges Cesar Ciampolini Neto (president), José Benedito Franco de Godoi, Alexandre Alves Lazzarini, Eduardo Azuma Nishi and Marcelo Fortes Barbosa Filho.
The 2nd Reserved Chamber of Business Law is composed of judges José Araldo da Costa Telles (president), Paulo Roberto Grava Brazil (president of the Group), Ricardo José Negrão Nogueira, Sérgio Seiji Shimura, and Mauricio Pessoa. (Information from the press office of the TJ-SP).
